MCLE Affidavit Filing Instructions

WHO NEEDS TO FILE?

If you are holding active status as of June 30th, you are required to file an annual MCLE affidavit.

You are not required to file if your status is inactive, retired, or judicial as of June 30th.

 DATES TO ADD TO YOUR CALENDAR:

June 30th:  Deadline to complete CLE hours.

September 15th:  Deadline to file MCLE affidavit. (Online filing will be available mid-July, giving you roughly two months to timely file your affidavit.)

CLE TRACKING PAGE INSTRUCTIONS

The CLE tracking page is a tool provided to our members to allow them to consolidate information re all CLE activity throughout the educational year. It is from within this tracking tool that you will proceed to the filing of your annual MCLE affidavit. The CLE tracking page is not your affidavit. You may add events and review State Bar events you've taken throughout the year. Completing the information on this page is not the same as filing your affidavit.

Arizona’s educational year runs from July 1 through June 30. Starting in mid-July, you will have the ability to proceed to the affidavit filing screen.

Additional Instructions

Non-Resident Filing

If you are not residing in Arizona, but are residing in and admitted to another MCLE jurisdiction, you are not required to enter your CLE activity on the CLE tracking page. You may use the tracking page for your records if you wish.

If that jurisdiction has no MCLE requirements, or if you are not complying with the CLE requirements in that jurisdiction, you must meet Arizona's annual requirement of 15 CLE hours, 3 of which are ethics-defined and enter your CLE activity on the CLE tracking page. Review the tracking page instructions before proceeding to the affidavit filing screen.

To file your MCLE affidavit, follow the instructions under "READY TO FILE" below.

Registered In-House Counsel

If you are an In-House Counsel registrant under Rule 38 and are complying with the MCLE requirements in the other state(s) in which you are admitted, you are not required to enter your CLE activity on the CLE tracking page. You may use the tracking page for your records if you wish.

If the other jurisdiction(s) do not require you to attain CLE, you must meet Arizona's annual requirement of 15 CLE hours, 3 of which are ethics-defined and enter your CLE activity on the CLE tracking page. Review the tracking page instructions before proceeding to the affidavit filing screen.

To file your MCLE affidavit, follow the instructions under "READY TO FILE" below.

Court Employees

If you are a court employee, and subject to COJET, you are not required to enter your CLE activity on the CLE tracking page. To file your MCLE affidavit, follow the instructions under "READY TO FILE" below.

State Bar of Arizona Certified Specialists

State Bar Certified Specialists will see check boxes by the name of each event. Click on this box to indicate the CLE event as advanced/specialist CLE. Specialists must have 12 hours of advanced level CLE hours in their area of specialization in order to file the affidavit. If a box is marked in error, click the box again to remove the check mark.

Judicial, Inactive or Retired Members

If your status as of June 30th is Judicial, Inactive, or Retired you have no requirement to file, and will not be able to access the filing screen.

 

Seminars

State Bar of Arizona CLE

Do not manually enter State Bar CLE events.

The State Bar program I’ve taken has not shown up on my tracking page:
State Bar CLE programs are entered for you automatically within 72 hours of completion. If a State Bar program does not appear on your tracking page after 72 hours, indicate your name, bar number and the issue in an email to clefix@azbar.org to resolve prior to filing your affidavit. Do not enter State Bar programs manually.

I took a State Bar program after the end of the educational year. How can I move it back?
If you've taken a State Bar program beyond the end of this educational year, and need the hours for compliance this year, go to next year's tracking page, click on the edit button to the right of the event. Change the MCLE year to the previous year. You will receive a warning message that the start date is not within the selected MCLE year, just click on OK. Save the seminar. This will move the event to the year in which you need the CLE credit. Do not enter State Bar programs manually.

How can I go back and claim an event from last year?
If you have an event that was not entered on last year's tracking page or affidavit and you would now like to claim credit, enter the event on the CLE tracking page for the year in which the event took place. If your affidavit for that year has already been filed, or you had no requirement to file an affidavit (new members), follow these instructions to request a manual adjustment of the carry forward hours.

How to file an amended affidavit

Here are the instructions on how to file an amended affidavit:

  • Add the event(s) to your CLE tracking page in the appropriate educational year
  • Once all of the events are added, print the CLE tracking page.
  • Highlight (or circle) the changes that were made; write “amendment” on the top of the page.  
  • Sign and date the amendment; scan and email (mcle@staff.azbar.org), or fax (602.271.4930), to the attention of the MCLE department.
  • Keep a copy of the amendment with your CLE records for the appropriate educational year in case of a court audit.

The update to your carry forward hours will be processed as soon as possible. Please allow at least 5–7 business days for completion.

How to claim credit for CLE hours when no requirement to file an affidavit

If you were first admitted January 1 or later, you had no requirement to take CLE. But if you did, you may claim CLE events after your date of admission through the end of the educational year (June 30).

Courses taken through the State Bar are automatically entered on the CLE tracking screen. If you have CLE hours from other providers, enter those hours. Be sure to enter the hours in the appropriate educational year. After you enter all of your hours on your CLE Tracking Page, print the page.

Write a note on the printout requesting the MCLE department to manually enter your carry forward hours.

Sign and date the printout.

Fax (602.271.4930) or email (mcle@staff.azbar.org) your request to the attention of the MCLE department.

The update to your carry forward hours will be processed as soon as possible. Please allow 5–7 business days for completion.

Entering seminars from other providers

To enter programs from providers other than the State Bar, click on the "Add a Seminar" button near the bottom of the screen.

Enter the requested information and save the seminar. Seminars should be added to the appropriate educational year. The date format must be MM/DD/YYYY. The instructions for calculating CLE hours can be found in MCLE Regulation 104(B) here: www.azbar.org/cleandmcle/mcle/mcleregulations.

READY TO FILE

I am ready to file my affidavit

Once you have all of your hours on your tracking page (if applicable) and are ready to file the MCLE affidavit, click on the "Continue to Next Step To File Your MCLE Affidavit" button at the bottom of the CLE tracking page.

MCLE AFFIDAVIT FILING INSTRUCTIONS:

The MCLE affidavit filing screen is the first step toward online filing of the annual MCLE affidavit.

Entering or reviewing information on this screen is not the same as filing your affidavit.

You must click on the "Submit Affidavit" button on the bottom of the screen in order to successfully file.

You will know that your affidavit has been successfully filed when you receive the “successful submission” screen, displaying a copy of your affidavit.

You will also receive a copy of your affidavit in the email mailbox that you entered when you completed the affidavit filing screen.

If you do not receive the “successful submission” screen or the email copy of your affidavit, you have not filed your affidavit.

There are several filing categories. For detailed instructions, click your filing category below.

ACTIVE / REGULAR, RESIDING IN ARIZONA

There are four sections to be completed in the MCLE affidavit filing process.


SECTION 1:

In section 1, click the radio button next to “Active/Regular”.

Members in this category must have at least 15 CLE hours, 3 of which are ethics, in order to file an MCLE affidavit. 009

Section 2 will show you the CLE events you entered on the CLE tracking page. Review this list for accuracy and completeness.

If changes are required, click on the "Make Changes or Add Seminars" button above and to the right of the event listing. This will return you to your CLE tracking page. After making your adjustments, return to the affidavit filing screen by clicking on “Continue to Next Step to File Your MCLE Affidavit”.

Here is where any applicable fees will appear. There are two types of late fees associated with MCLE requirements.

If you didn’t complete your CLE hours by the end of the educational year (June 30), a late compliance fee will apply.

If you didn’t file your affidavit by the filing deadline (September 15), a late filing fee will apply.

If there is a fee displayed in this section when neither of these situations apply, do not file your affidavit until you contact the MCLE department (mcle@staff.azbar.org) to resolve.

CERTIFIED SPECIALIST

There are four sections to be completed in the MCLE affidavit filing process.

Members in this category must have at least 12 advanced/specialist CLE hours in their area of specialization, and 3 ethics hours, in order to meet minimum compliance and file an MCLE affidavit.

NON-RESIDENT

There are four sections to be completed in the MCLE affidavit filing process.


SECTION 1:

In section 1, click the radio button next to “Non-Resident”. Two options will open up.

If you are required to meet Arizona's annual MCLE requirements, click the radio button for “I am in compliance with Arizona’s requirement”.

If you are residing in another MCLE jurisdiction and subject to and complying with that jurisdiction’s MCLE requirements, click the radio button for “I am admitted to and live in MCLE jurisdiction of...”. Select your MCLE jurisdiction from the drop-down list.

If your MCLE jurisdiction is not listed, type the name of the jurisdiction in the box provided (e.g. Puerto Rico, etc.).

SECTION 2:

If you are required to meet Arizona's requirements, the CLE events from your tracking page are listed in Section 2. Members in this category must have at least 15 CLE hours, 3 of which are ethics, in order to file an MCLE affidavit. Section 2 will show you the CLE events you entered on the CLE tracking page. Review this list for accuracy and completeness.

If changes are required, click on the "Make Changes or Add Seminars" button above and to the right of the event listing. This will return you to your CLE tracking page. After making your adjustments, return to the affidavit filing screen by clicking on “Continue to Next Step to File Your MCLE Affidavit”.

If you are claiming compliance with another jurisdiction, you may have events entered in Section 2, but may continue the filing process even though the Arizona MCLE requirements are not satisfied.

IN-HOUSE COUNSEL, RULE 38

There are four sections to be completed in the MCLE affidavit filing process.


SECTION 1:

In section 1, click the radio button next to “In-House Counsel, Rule 38”.

The next line will open up allowing you to select the MCLE jurisdiction with which you are complying.

If your other jurisdiction(s) do not have an MCLE requirement, or you are not complying with the requirements, select Arizona from the drop-down list. In this case, you must meet Arizona's annual MCLE requirement of 15 CLE hours, 3 of which are ethics.

FAQs

The State Bar program I’ve taken has not shown up on my tracking page. How to fix?

State Bar CLE programs are entered for you automatically within 72 hours of completion. I’m a new attorney, what are my CLE requirements?

The educational year runs from July 1 through June 30. If you were admitted between July and December of the educational year, you have a reduced requirement of 10 CLE hours, 2 of which are ethics. If you were admitted between January and June of the educational year, you have no CLE requirements and no requirement to file an MCLE affidavit.

I’m a new member and completed CLE hours when I had no requirement to file. Can I claim those hours?

You may claim CLE events after your date of admission through the end of the educational year (June 30).

Courses taken through the State Bar are automatically entered on the CLE tracking screen. If you have CLE hours from other providers, enter those hours. Be sure to enter the hours in the appropriate educational year. After you enter all of your hours on your CLE Tracking Page, print the page.

How can I go back and claim an event from last year?

How to file an amended affidavit

Here are the instructions on how to file an amended affidavit:

  • Add the event(s) to your CLE tracking page in the appropriate educational year.
  • Once all of the events are added, print the CLE tracking page.
  • Highlight (or circle) the changes that were made; write “amendment” on the top of the page.
  • Sign the amendment; scan and email (mcle@staff.azbar.org), or fax (602.271.4930), to the attention of the MCLE department.

There is a fee assessed on my affidavit filing screen, but I don’t think I owe a fee.

If you took all your CLE events by June 30 and your affidavit screen is showing a late compliance fee, return to your CLE tracking page and check the date of completion for each event. You may have accidentally indicated the wrong month or the wrong year.

If you completed your CLE after June 30, you do owe the late compliance fee.

If you are filing your affidavit after September 15, you do owe the late filing fee.

I taught part of an event and attended the rest. How do I enter this on the tracking page?

You will have two separate entries for this event; one for the teaching hours, and one for attending.

State Bar CLE events:

If you taught part of a State Bar CLE event and attended the rest, there may already be an entry for this event in the “AZ Bar CLE” section of your tracking page. You will need to reduce the hours for the State Bar entry by the number of hours you taught at the event.

For example, if you taught one hour at a six hour event, change the State Bar entry to 5 CLE hours. To do this, click on the edit button to the right of the event and change the CLE hours. You can reduce the hours on a State Bar entry, but not increase. To claim the teaching hours, calculate the hours based on the formula in the MCLE Regulations (104(B)(3)). See the instructions in the following question/answer. Teaching hours will be entered as either “Teaching – Original Presentation” or “Teaching – Repeat Presentation”.

If you taught part of an event from another provider, you will make two entries.

Teaching hours will be entered as either “Teaching – Original Presentation” or “Teaching – Repeat Presentation”.

Calculate the hours based on the formula in the MCLE Regulations (104(B)(3)). See the instructions in the following question/answer.

Your second entry will be for the total time of the seminar minus the time spent teaching. This entry will have the CLE type “Live/In-Person”.

How do I calculate teaching hours (including the ethics portion)?

For an original presentation accompanied by original written materials prepared, augmented or updated by the speaker:

The first hour is equivalent to 6 CLE hours.

Each additional hour is equivalent to 2 CLE hours.

For example, you taught an hour and a half and prepared and presented original materials:

The first hour = 6 CLE hours

The next half hour (.5 X 2) = 1 CLE hour

For a total of: 7 CLE hours

And, another example, you taught 45 minutes and prepared and presented original materials:

You may claim (.75 X 6) = 4.5 CLE hours

Repeat presentations, or original presentations without written materials earn 1:1 CLE hours. A 3 hour repeat presentation earns 3 CLE hours.

If the subject of your entire presentation is ethics-defined, ethics hours are the same as teaching hours. If a portion of your presentation is ethics-defined, calculate the ethics hours with the same formula as teaching hours.

For example, you taught an hour and a half original presentation, a half hour of which was ethics:

Ethics portion was .5 hours (.5 X 6) = 3 CLE hours

Your entry would reflect 7 CLE hours, 3 of which are ethics.

Teaching hours are capped at 10 hours per educational year.

How do I enter pro bono services CLE hours on my tracking page and affidavit?

Effective January 1, 2014, attorneys may claim 1 CLE hour for every 5 hours of pro bono service provided through an approved Legal Services Organization (under Rule 38). The CLE hours claimed fall into the CLE type of self-study (capped at 5 CLE hours per educational year.

The tracking page/affidavit entry must contain the following:

CLE Type: Self Study (CD, DVD, Arbitration or Pro Bono)
Title: Pro Bono Service Provided Through (name of Legal Services Organization)
Organization: Attorney’s Name (as the provider of the service)
City/State: City/State in Arizona where the service was provided
Start Date*: January 1, 2014 or later (within the educational year)
End Date: Date of resolution of the case or June 30 (within the educational year)
CLE Hours: 1 CLE hour is earned for every 5 hours of pro bono service. Calculate number of pro bono service hours, divide by 5, round down to the nearest quarter hour. Hours are self-study, capped at 5 per educational year.

*Amendment to Ariz. R. Sup. Ct. Rule 45 allowing CLE credit for pro bono service is effective January 1, 2014

Verification of pro bono service hours will be a document produced by the attorney or legal services organization (LSO) to include the name of the LSO, date(s) of service, the number of service hours provided, the number of self-study hours being claimed, signed by a representative of the LSO affirming the attorney’s service.
