Backyard chickens have gone from a growing trend to a full-fledged movement, but the legality of raising your own eggs is complicated by a patchwork of state and local laws as well as neighborhood-specific regulations. This CLE will examine the many legal issues in raising backyard birds, including the number of birds permitted, noise and odor nuisance issues, restrictions on lot size and type of dwelling, and specifications for chicken coop architecture and placement. This presentation will focus on what happens to intellectual property assets when a debtor files bankruptcy. The discussion will include what property is included in the bankruptcy estate, how the bankruptcy automatic stay applies to intellectual property disputes, what type of license agreements and other contracts may be considered “executory contracts” and how the bankruptcy court will treat those executory contracts, including limitations on the assignments of those licensing agreements, and how the bankruptcy court may treat other intellectual property assets.
